In India, a Living Will or Advanced Medical Directive (AMD) allows an individual to decide his\/her medical treatment in advance if he\/she becomes terminally ill or incapacitated. This legal document ensures that <a>his\/her <\/a>wishes regarding life-sustaining treatments are respected, hence reducing emotional and ethical burdens on family members.&nbsp;<\/p>\n\n\n\n<p>In this blog, we\u2019ll explore:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>What is a Living Will?\u00a0<\/li>\n\n\n\n<li>Legal status of it in India\u00a0<\/li>\n\n\n\n<li>How to create one\u00a0<\/li>\n<\/ul>\n\n\n\n<p><strong>What is a Living Will?<\/strong><\/p>\n\n\n\n<p>It is a <strong>legal document<\/strong> where a person <strong>specifies his\/her preferences<\/strong> for medical treatment if they become unable to communicate due to a terminal illness, coma, or irreversible condition. It includes instructions on <strong>withholding<\/strong> or <strong>withdrawing<\/strong> life support such as:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Cardio-pulmonary resuscitation (CPR)\/ Do Not Resuscitate (DNR) orders\u00a0<\/li>\n\n\n\n<li>Intravenous fluids and medications including antibiotics; excluding those that would provide comfort or relieve suffering\/pain<\/li>\n\n\n\n<li>Dialysis<\/li>\n\n\n\n<li>Ventilation or other kinds of artificial life support<\/li>\n\n\n\n<li>Chemotherapy<\/li>\n\n\n\n<li>Radiotherapy<\/li>\n\n\n\n<li>Surgery, unless it is for symptom control or to improve the quality of my life<\/li>\n\n\n\n<li>Artificial administration of nutrition and hydration<\/li>\n\n\n\n<li>Palliative care preferences\u00a0<\/li>\n\n\n\n<li>Unlike a traditional will (which deals with property after death), a Living Will applies while the person is alive but incapacitated.\u00a0<\/li>\n<\/ol>\n\n\n\n<p><strong>Legality of a Living Will. Is a Living Will legal?<\/strong><\/p>\n\n\n\n<p>Yes! The <strong>Supreme Court of India<\/strong>, in its landmark <strong>March 2018<\/strong> judgment (Common Cause vs. Union of India), recognized the <strong>Right to Die with Dignity<\/strong> under <strong>Article 21<\/strong> (Right to Life) of the Constitution. The court laid down guidelines for creating and enforcing Living Wills.&nbsp;<\/p>\n\n\n\n<p><strong>Legal Conditions:&nbsp;<\/strong><\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Appoints a guardian or surrogate decision-maker.<\/li>\n\n\n\n<li>Must be made voluntarily by a person of sound mind.<\/li>\n\n\n\n<li>Requires witnesses and a notary attestation.\u00a0<\/li>\n\n\n\n<li>Can be revoked or modified anytime.\u00a0<\/li>\n\n\n\n<li>Comes into effect only when the person is terminally ill\/incapacitated with no hope of recovery.\u00a0<\/li>\n<\/ol>\n\n\n\n<p><strong>How to create a Living Will in India?<\/strong><\/p>\n\n\n\n<p><strong>Step 1: Draft the Document<\/strong><\/p>\n\n\n\n<p>The Living Will should clearly state:&nbsp;<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Your name, age, and address\u00a0<ol><li>A declaration that you are of sound mind\u00a0<\/li><\/ol><ol><li>Specific medical conditions where it should apply (e.g., irreversible coma, terminal illness)\u00a0<\/li><\/ol><ol><li>Instructions on life support, pain management, and organ donation (if any)\u00a0<\/li><\/ol><ol><li>Instructions on desires of EOLC, Choice of place of treatment, choice of treating physician.<\/li><\/ol><ol><li>Appointment of healthcare proxy or power of attorney for heath related decisions.<\/li><\/ol>\n<ol class=\"wp-block-list\">\n<li>Directions to be followed upon death about organ donation, cadaver donation and wishes pertaining to last rites.<\/li>\n<\/ol>\n<\/li>\n<\/ol>\n\n\n\n<p><strong>Step 2:<\/strong> Sign in the Presence of Witnesses<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Two witnesses (unrelated, not beneficiaries) must sign.\n<ol class=\"wp-block-list\">\n<li>A notary public or gazetted officer must attest it.\u00a0<\/li>\n<\/ol>\n<\/li>\n<\/ol>\n\n\n\n<p><strong>Step 3<\/strong>: Submit to the Hospital &amp; Family. Give copies to:&nbsp;<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Your family doctor\/hospital\u00a0<ol><li>Close family members\u00a0<\/li><\/ol><ol><li>Your legal heir or healthcare proxy<\/li><\/ol>\n<ol class=\"wp-block-list\">\n<li>Your concerned Municipal office for documentation purposes<\/li>\n<\/ol>\n<\/li>\n<\/ol>\n\n\n\n<p><strong>Step 4<\/strong>: Review &amp; Update Periodically&nbsp;<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>You can modify or revoke it anytime by submitting a fresh document.\u00a0<\/li>\n<\/ol>\n\n\n\n<p><strong>Step 5:<\/strong> Activation<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>If the executor becomes terminally ill\/incapacitated, the hospital ethics committee reviews the Living Will.<ol><li>A medical board evaluates the condition.<\/li><\/ol>\n<ol class=\"wp-block-list\">\n<li>Hospital EOLC (End of Life Committee) approval is required before withholding \/withdrawing treatment.<\/li>\n<\/ol>\n<\/li>\n<\/ol>\n\n\n\n<p>In conclusion, A Living Will ensures that a person\u2019s medical choices are honored, sparing their loved ones from painful decisions.
